LIMITED WARRANTIES
While The Flex Company’s (“Flex”) products have changed thousands of lives for the better, we know that we can't satisfy 100% of our customers. If one of our products isn't working for you, please reach out to our team of Flexperts at help@flexfits.com to get help. If you're still unhappy, we've outlined options below to get a replacement product.
WHAT ARE YOUR REMEDIES UNDER THESE LIMITED WARRANTIES?
Because Flex products are regulated medical devices and there are related health and safety concerns associated with use of these products, we are unable to accept any returns, exchanges, or refunds. As a result, the sole remedy available under any of these Limited Warranties is limited to a replacement product. We will also pay for shipping and handling fees to send a replacement product to you. The applicable warranty periods set forth below are not extended if we replace a product.
Flex Cup - Perfect Fit Guarantee Limited Warranty
How things fit and vibe with you is key—a great pair of jeans, a bold new jumpsuit, and Flex Cup. Our Perfect Fit Guarantee exists to help you have the best possible experience with your Flex Cup. Here's how it works: If Flex Cup doesn't feel right, reach out to our Flexperts, who will work with you to find the perfect fit. This could mean trying a different fold, position, or size. There is a learning curve and we're here to help you get through it. You got this! Check in with us at help@flexfits.com to connect with a real human and become a Flex Cup pro.
If 1) you are still not satisfied with your Flex Cup after using it for two (2) period cycles; 2) you provide proof of purchase dated within the last six (6) months; and 3) you are a US-based customer, we will send you a replacement Flex Cup in a different size at our cost, subject to the exclusions below.
Disc and Cup Products - Manufacturing Defects Limited Warranty
We warrant that Flex Cup, Flex Disc, Flex Reusable Disc, and Flex Plant+ products will be free from manufacturing defects for a period of twelve (12) months from the date of purchase, subject to the exclusions below.
If you 1) provide a photo showing a manufacturing defect on the product; and 2) proof of purchase dated within the last twelve (12) months from www.flexfits.com or directly from Flex on www.amazon.com, we will send you a replacement of your defective product at our cost.
All Other Products - Manufacturing Defects Limited Warranty
Flex warrants that its pads, liners, supplements, washes, wipes, and disposal pouches will be free from manufacturing defects for a period of thirty (30) days from the date of purchase, subject to the exclusions below. If you provide 1) a photo of a manufacturing defect; and 2) proof of purchase dated within the last thirty (30) days from www.flexfits.com or directly from Flex on www.amazon.com, we will send you a replacement of your defective product at our cost.
EXCLUSIONS ON ALL WARRANTIES
- These Limited Warranties do not cover discoloration from normal wear and tear, improper care, modification of the product, customer negligence, damage due to misuse or improper use, or actions or events beyond our reasonable control.
- These limited warranties are non-transferable from the original purchaser.
- Users are limited to one replacement per product under our Limited Warranties every twelve (12) months.
- Retail: Unfortunately, with the exception of the Flex Cup Perfect Fit Guarantee, our warranties do not apply to products purchased at a retail location. If you purchased one of our products from a retailer (such as CVS, Walmart, or Target), you must try to return an unwanted or defective product to the retailer for a refund/exchange. These returns are subject to the retailer's return/exchange policy and may require you to show proof of purchase and the product to be unopened and/or unused.
- Unauthorized Resellers: Because Flex cannot control the quality of products sold by unauthorized sellers, these limited warranties apply only to Flex products that were purchased from www.flexfits.com, directly from Flex on www.amazon.com (or, in the case of the Flex Cup Perfect Fit Guarantee, also from a retail location). These limited warranties do not apply to products sold by unauthorized sellers on Amazon or elsewhere.
Our authorized resellers are selected for their ability to properly represent and sell Flex products. Unfortunately, Flex products are sometimes sold by companies that are not authorized to do so and do not meet our expectations of quality and customer care. Many sellers who sell through Amazon are not authorized resellers of Flex products. When purchasing Flex products on www.amazon.com, please pay attention to where the product is being "shipped from and sold by," which is stated clearly in the header for each product. Often, it can appear that products are being sold by Flex when this is not the case. Please contact us directly at help@flexfits.com before purchasing if you are unsure if the seller is an authorized reseller of Flex products.
- Except to the extent prohibited by applicable law, the express warranties stated above are in lieu of any other warranties, whether express or implied, including but not limited to any implied warranties of merchantability or fitness for a particular purpose, which are disclaimed.
- The Flex Company reserves the right to require a valid proof of purchase, verify information provided, and to deny any requests in our sole discretion in cases of suspected fraud or if a customer has not complied with the letter and spirit of this policy (including without limitation if the customer has provided falsely, misleading or otherwise inaccurate or incomplete information).
How Do You Obtain Warranty Service?
To submit a warranty claim, please email help@flexfits.com and submit the following information:
- Product model #
- Proof of purchase
- A picture of your product showing the defect
Changes
We may change the availability of these Limited Warranties at our discretion, but any changes will not be retroactive.
LIMITATION OF LIABILITY
THE REMEDIES DESCRIBED ABOVE ARE YOUR SOLE AND EXCLUSIVE REMEDIES AND OUR ENTIRE LIABILITY FOR ANY BREACH OF THESE LIMITED WARRANTIES. OUR LIABILITY SHALL UNDER NO CIRCUMSTANCES EXCEED THE ACTUAL AMOUNT PAID BY YOU FOR THE DEFECTIVE PRODUCT, NOR SHALL WE UNDER ANY CIRCUMSTANCES BE LIABLE FOR ANY CONSEQUENTIAL, INCIDENTAL, SPECIAL OR PUNITIVE DAMAGES OR LOSSES, WHETHER DIRECT OR INDIRECT.
SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.
